This training explores some of the more common, repeating examples of prosecutorial error that occur in California felony jury trials. Specific case examples illustrate best practices to avoid these errors and address the intersection with instructional error and ineffective assistance of counsel. The goal is to develop a broader understanding of how to approach related issues during trial.

This presentation will begin with a brief overview of the QDRO process, and then continue with a discussion of the various ways family law attorneys can avoid problem arising from retirement plan divisions. Topics covered will include bifurcating marital status (including joinders and provisional QDROs), drafting MSAs and other written agreements to divide retirement plans, and the use of models provided by retirement plan administrators when drafting QDROs in-house. Materials will include sample language to help attorneys avoid the issues covered in the presentation.

In 2020, the California Lawyers Association (CLA) and the D.C. Bar announced their participation in a groundbreaking research project conducted by attorney mental health and well-being expert Patrick Krill and Dr. Justin Anker. The first phase of findings from the study, “Stress, drink, leave: An examination of gender-specific risk factors for mental health problems and attrition among licensed attorneys”, was released in 2021 shedding light on the disparate experiences of women practitioners. |

Arbitration has grown in leaps and bounds over the last few decades. Court crowding, the difficulty of even getting before a judge on minor motions, judges’ predilection to toss cases via summary disposition as a way of pruning dockets, partisan judges – all these factors have pushed many run-of-the-mill commercial cases into arbitration.

Within the relevant historical context, tribal courts in the state will be discussed generally as well as through case studies from California’s northern, central, and southern regions. The presentation will also highlight the ways in which California law, federal Indian law, and tribal law intersect before tribal courts in the state. Registration will support a summer fellowship opportunity for a tribal law student in California in 2024.
