The challenge of enforcing brands online is ever-evolving. In Europe there have been recent developments on both the mechanisms for doing so (ordering ISPs to block websites) and in the rules about which courts have jurisdiction when relying on EU trademarks. Meanwhile, there are open questions before Europe's highest court about the validity (or otherwise) of exhaustive recitations of goods/services.
