The challenge of enforcing brands online is ever-evolving. In Europe there have been recent developments on both the mechanisms for doing so (ordering ISPs to block websites) and in the rules about which courts have jurisdiction when relying on EU trademarks. Meanwhile, there are open questions before Europe’s highest court about the validity (or otherwise) of exhaustive recitations of goods/services. Europe has had to enact harmonizing reforms from the TM Directive, which have an impact on the registrability of non-traditional marks. Against this background, Europe looks at the risk of fragmenting with the looming departure of the UK from the EU. Mr. Aries will give participants tips on what all of this means for brand owners.

Moderator: Carole Barrett
