In this program, government officials and experienced practitioners will share their perspectives on recent trends in antitrust law enforcement. The discussion will be of interest to antitrust specialists and to practitioners in other fields alike. Topics will include DOJ and FTC antitrust enforcement priorities and recent civil and criminal matters; the in-house perspective on the current antitrust landscape; the merger review process under the 2023 Merger Guidelines; proposed changes to the Hart-Scott-Rodino premerger notification rules and forms, and their practical impact for business; and the revitalized popular interest in antitrust.

This program is designed as an update on pending litigation at the intersection of artificial intelligence and antitrust, focusing on cases involving claims of algorithmic collusion in violation of Section 1 of the Sherman Act. Seasoned practitioners from the plaintiffs and defense bar will have a roundtable discussion updating the audience on divergent rulings at the district court level and the state of play at the appellate level on various legal challenges to algorithmic collusion.
