As the sheer volume of evidence found online continues to grow, understanding the requirements for proper authentication is essential for attorneys.

This seminar will focus on the rules governing the admissibility of online evidence under the Federal Rules of Evidence (FRE) 901 and 902(13).

Attendees will gain practical knowledge of how courts evaluate the authenticity of digital evidence, including the common pitfalls that lead to the exclusion of web-based content like basic screenshots and insufficient metadata.
The seminar will explore the criteria for self-authenticating electronic evidence examine how various collection methods align with these requirements.

This session aims to equip attorneys with the tools and understanding necessary to navigate the nuances of digital evidence authentication. Participants will leave with a clearer perspective on how to ensure their online evidence withstands admissibility challenges, and ways to alleviate the burden of drafting affidavits or providing in-court testimony about collection methods.
