Worker classification remains a critical issue in California, particularly following the enactment of the Freelance Worker Protection Act (SB 988) and the passage of AB5 in 2020, which codified the California Supreme Court’s 2018 decision in Dynamex Operations West, Inc. v. Superior Court of Los Angeles. Accurate worker classification is paramount in mitigating the risk of liability arising from claims of misclassification and the subsequent legal consequences. This program will address the requisite steps that a hiring entity must undertake to ensure workers are appropriately classified as either employees, independent contractors, or freelance workers.
