The program will focus on three key areas: (1) the fundamental basis of the statute, how it is structured, and additional rights that it creates for consumers; (2) who is covered by the statute, including who qualifies for protection, what businesses the act applies to and how it will affect them, and organizations that are exempt; and (3) enforcement mechanisms under the statute, including what penalties and private rights of action are available, and how the potential claims/liabilities may generate class action litigation for certain data breaches that result from violations of a business’s duty to implement and maintain reasonable security practices and procedures appropriate to the risk arising from existing California law. |

In the 2014 decision of Lintz v. Lintz the court applied Family Code section 721 to estate plans. Section 721 imposes a duty of the highest good faith and fair dealing on spouses, and a statutory presumption of undue influence arises wherever one spouse obtains an advantage over the other. Probate Code section 21385 was amended to remove the presumption created by the Lintz case. Other legislation passed protects elders from aggressive Care Custodians.

When the result of a bench trial goes up on appeal, the factor most influential on the result is the statement of decision. A statement of decision can also have other important ramifications for the effect of a court decision on future proceedings between the parties, regardless of whether an appeal occurs.

With sea level rise and the increased frequency of coastal flooding, threats to coastal residences, coastal infrastructure risks, beach erosion and beach loss, saltwater intrusion into coastal aquifers and compromised shoreline safety are increasingly apparent. This panel will cover threats to the coastline from climate change-induced sea level rise, mitigation efforts to address those impacts, financial challenges to mitigation and equity in mitigation conversations.

Come learn about the important changes to Rule 1.15 of the Rules of Professional Conduct which have greatly expanded the obligations of attorneys to maintain advanced fees in trust and to account, report and pay out entrusted funds to third parties (not solely their clients). This program will cover the only carve out for the requirement for depositing advanced fees into a trust account for flat fees, and explain the difference between an hourly, flat fee or true retainer agreement.
