Webinar: AB 5 & The Unintended Employee: The Future of Worker Categorization, Risks and Litigation Exposure
This program will focus on the changes to worker categorization prompted by the adoption of AB 5 this fall that followed the decision of Dynamex Operations West, Inc. v. Superior Court of Los Angeles. In addition, the program will provide an overview of the risks if employers misclassify workers and predictions for how AB 5 will impact the gig economy in California.
Webinar: AB 5: The Codification of the ABC test – A Franchising Perspective
Assembly Bill 5 (AB 5) goes into effect on January 1, 2020 and codified the ABC test adopted by the California Supreme Court in Dynamex Operations West, Inc. v. Superior Court, 4 Cal.5th 903 (2018) (“Dynamex”). AB 5 makes radical changes to the way California law analyzes the treatment of workers as independent contractors. This program reviews the impact AB 5 may have on businesses, with a focus on franchising, including, whether and how AB 5 potentially changes the relationships between franchisors, franchises and franchisee employees. Issues discussed will include changes in the analysis of worker classification as independent contractors, exemptions with AB 5, and impact on common law theories of liability (i.e., vicarious, joint employer, and agency). The panel will provide a perspective of AB 5 from that of a franchise litigator, franchise compliance attorney, franchisee attorney, and franchise in-house attorney.

Webinar: Recent Developments in Internet and Privacy Law Affecting California Consumer Financial Service Providers
The program will focus on three key areas: (1) the fundamental basis of the statute, how it is structured, and additional rights that it creates for consumers; (2) who is covered by the statute, including who qualifies for protection, what businesses the act applies to and how it will affect them, and organizations that are exempt; and (3) enforcement mechanisms under the statute, including what penalties and private rights of action are available, and how the potential claims/liabilities may generate class action litigation for certain data breaches that result from violations of a business’s duty to implement and maintain reasonable security practices and procedures appropriate to the risk arising from existing California law.
