Webinar: Copyright Infringement & Social Media: Embedding in a State of Flux

Technology typically outpaces changes in the law. With social media becoming a prominent method to disseminate information, traditional principals of law have been stretched. This presentation will address the divergent views of long-established precedent in the Ninth Circuit in Perfect 10 and recent decisions in District Courts within the Second Circuit when evaluating copyright infringement claims for the use of others’ content through embedding and in-line linking. We’ll also look at the positions of various social media platforms that require users to agree to terms and conditions protective of the platforms while offering no clear protection for the users.

Speakers: Adam Bialek and Sarah Fink


Adam Bialek is co-chair of Wilson Elser’s Intellectual Property practice and a member of the firm’s Information Governance Leadership Committee. His nationwide team of highly qualified attorneys offers clients a full range of IP and cyber/media legal services. Sarah Fink focuses her practice on all types of intellectual property (IP) litigation and protection, including patent, trademark, copyright, and trade secret. She has extensive experience with litigating IP infringement actions in all industries, with a specialty in the life sciences and technology sectors. Sarah also litigates and arbitrates IP-related business disputes, such as false advertising and unfair competition claims, in state and federal court.
