The following regulatory information may be of interest to attorneys practicing insurance law.

Department of Insurance Regulations Currently Under Review by the Office of Administrative Law

The only California Department of Insurance (CDI) regulation currently under review by the Office of Administrative Law (OAL) is OAL #2020-0717-02, which changes the location of the CDI Bay Area office from San Francisco to Oakland.

Office of Administrative Law Actions on Department of Insurance Regulations

OAL has approved the following CDI rulemaking submissions during the past 45 days:

• Special Investigative Units – OAL File #2020-0619-07. These regulations clarify requirements of an insurer’s unit or division responsible for investigating possible fraudulent claims by insureds or persons making claims.
• CAARP Simplified Manual of Rules and Rates – OAL File #2020-0609-04. Modifies rating procedures used by the California Auto Assigned Risk Program. Noncontroversial. Exempt from Administrative Procedure Act (APA) review.
• CAARP Plan of Operations – OAL File #2020-0609-06. Modifies Plan of Operations for the California Auto Assigned Risk Program. Noncontroversial. Exempt from APA review.
• FAIR Plan Methodology to Calculate Insurer Credits – OAL File #2020-0507-01. Makes non-substantive changes to the regulations governing calculation of credit for insurer voluntary writings in FAIR Plan areas.
