This seminar discusses how to take entity depositions effectively and efficiently, ensuring that the other side will have to play fair and answer your legitimate questions. We will review the mechanics of the deposition, how to word the document requests, and what questions to ask during the deposition to tee up a winning motion to compel if necessary. We will also discuss your duties when representing a corporate entity.

This presentation explores the ethical issues related to the use of expert witnesses in dispute resolution. Topics include: rules of professional conduct applicable to presenting witnesses generally; how to ethically prepare and use an expert witness; interacting with your opponent’s experts; the difference between consulting experts and testifying experts, and implications with respect to discovery; and the ethical and practical constraints on expert witnesses, particularly when the expert is an attorney.

Online defamation is a growing problem. The program will explore this emerging area of law, and cover the right to anonymous free speech balanced against the right to unmask the identity of online defamers. We will discuss recent published cases involving Yelp and Glassdoor.
