Stephen Lerner was appointed by Governor Brown as Assistant Commissioner for Legal Affairs (Chief Counsel) on November 2, 2015. In this position, he serves as the principal legal advisor to the department, Commissioner, and executive team and oversees the department’s legal program.
Topics will include an overview of the following lease provisions: Term, Rent, CAM/operating expenses, security deposits (including letters of credit and guaranties), repairs, surrender, holding over, subordination, insurance/indemnification, landlord remedies, standard statutory waivers, construction issues (including work letters) and renewal options.
Often times a transactional commercial real estate client will reach out to the attorney who helped draft their lease with an issue that has arisen from the lease and the question is when and how should that attorney seek assistance from a litigator. This program will provide hypothetical situations from a transactional attorney’s perspective and then discuss those situations
