From time to time, the Quarterly collects a number of articles that concentrate on a particular area of trusts and estates law. Such is the case for this issue, in which all of the articles focus on trust and estate litigation. While I know this issue will be very helpful to our members who litigate, I believe that it will also be valuable to those (like me) who don’t.
Ciarán O’Sullivan authored our Tips of the Trade article, which reviews the facts and holdings of Conservatorship of O.B. and how the case may impact appeals of trusts and estates cases.
Scott A. Fraser and Matthew R. Owens have co-authored a very informative article on discovery and electronically stored information. This article is the first of a two-part series and covers the general rules governing electronically stored information and the application of the rules to trust and estate cases. The second part of this article will appear in our next issue and will cover responses to e-discovery. Spearheaded by Herb A. Stroh, our Executive Committee has begun publishing podcasts on trust and estate issues. A podcast interview with Scott and Matt on e-discovery and their article is available.
