Criminal Law

Crim. Law Journal Winter/Spring 2017, Vol. 17, Issue 1

MESSAGE FROM THE CHAIR

It is my pleasure to introduce this edition of the Criminal Law Journal. The first article, More than Civil Death: Considering Collateral Consequences in Federal Sentencing, is authored by Kaitlin D. Beck, a law student at The University of Chicago School of Law. Ms. Beck is the winner of the 2016-2017 Marshall Schulman Student Writing Competition. She has penned a wonderful article, one that will benefit the practitioner in federal court, and may be influential to courts tasked with imposing lawful sentences upon defendants facing harsh collateral consequences such as deportation. Can California Lawyers Ethically Light Up? is written by Wendy Patrick, another advisor and past Chair of the Executive Committee. These articles demonstrate the commitment of the Criminal Law Journal to publishing articles that will enhance the practice of California lawyers practicing in the criminal courts, and that will advance the goal of providing competent legal representation.

This is an exciting time for the Criminal Law Section. Proposed legislation now before the Legislature will make the Sections separate from the State Bar. The purpose of the change is to allow the State Bar to maintain a focus upon attorney discipline, while giving the Sections, as producers of legal programs and publications, the flexibility needed to serve California lawyers. It is expected that in 2018, the Sections of the State Bar will be operating as a legislatively chartered entity, and though separate from the State Bar, will have a legally established special relationship with the State Bar. Members will continue to be able to pay their Section dues at the same time as their general Bar Dues. The change in the relationship between the Sections and the State Bar will not interfere with the publications and presentations of the Criminal Law Section. The Criminal Law Section continues to be committed to providing quality educational programming, and will be presenting three programs at the 2017 Section Convention at the Sheraton San Diego Hotel & Marina on August 18-19. We hope to see you there!
