MCLE: Self-Study Article – Using Metadata in Depositions

Summary: While many California attorneys utilize metadata during civil litigation and investigative reviews, many California attorneys fail to incorporate metadata in offensive and defensive depositions. This article states the relevant rules Federal Rules of Civil Procedure and California Code of Civil Procedure in regards to metadata, describes what metadata is, discusses how metadata is currently used and outlines how attorneys may utilize exhibit metadata in offensive and defensive depositions.
