Proposed Rules Amendments Published for Public Comment. The Judicial Conference Committee on Rules of Practice and Procedure (Standing Committee) has published proposed amendments to the following rules:

  • Appellate Rules 2 and 4;
  • Bankruptcy Restyled Rules for the 3000 to 6000 Series; Rules 3002.1, 3011, and 8003; and new Rule 9038;
  • Official Bankruptcy Forms 101, 309E1, 309E2, and 417A; and new Official Forms 410C13-1N, 410C13-1R, 410C13-10C, 410C13-10NC, and 410C13-10R;
  • Civil Rules 15, 72, and new Rule 87;
  • New Criminal Rule 62; and
  • Evidence Rules 106, 615, and 702.

Central District of California

Covid-19 Update: The District Court extended the CARES Act through August 15, 2021, therefore video and telephonic hearings may continue to be held in certain criminal matters. In the Western Division (Los Angeles), criminal duty matters will be held in Courtroom 880 of the Roybal Courthouse through August 13, 2021. Effective August 16, 2021, all criminal duty matters will be held in person. In the Western Division, Criminal Duty will be held in Courtroom 10C of the First Street Courthouse until further notice due to construction at Roybal. In the Southern and Eastern divisions, criminal duty matters will be held in the duty magistrate’s courtroom. (Notice)

On July 28, 2021, the Court updated its guidance about the wearing of face coverings or masks. Pursuant to guidance from the CDC, all individuals seeking entry to any CDCA Courthouse or the Probation or Pretrial Services Offices, regardless of vaccination status, must wear face coverings or masks. Southern District of California

Covid-19 Update: The Southern District of California has resumed normal operations. Previous limitations on the scope of jury were lifted on July 6, 2021. (See CJO 36-C) Most other proceedings typically can proceed by telephone or videoconference. (See, e.g., id.CJO 63-D). Face coverings are required for visitors that are nor fully vaccinated. (See CJO 59-A.)

Criminal Justice Act Defense Panel Application: The Court is accepting applications for admission to the CJA Criminal Defense Panel and the CJA Material Witness Defense Panel. (Notice and Notice.) Completed applications must be submitted between July 19, 2021 and October 18, 2021.

Northern District of California

Proposed Rule Changes: The Northern District has approved proposed substantive modifications to certain Civil Local Rules. Public comments on the proposed modifications are due September 3, 2021 and may be submitted to media@cand.uscourts.gov.

Covid-19 Update: Effective August 2, 2021, all visitors to a Northern District courthouse must review the court’s COVID-19 pre-screening questionnaire before arriving at the courthouse and, effective July 29, 2021, all jurors, attorneys, court staff, and other courthouse visitors, regardless of vaccination status, are required to wear masks within public or common areas of courthouse property. Additionally, the Northern District is holding “hybrid” in-court criminal proceedings incorporating Zoom, regarding which additional information is available on the Court’s website.

Eastern District of California

Covid-19 Update: All federal courthouses in the Eastern District of California remain open to the public (Notice). Criminal and civil jury trials are being held in-person. Judges shall determine whether to hold other proceedings in person or by telephone or videoconference. Civil proceedings are primarily being held by telephone or videoconference.
