Webinar: ADR for Real Property Disputes – Advanced Tools and Ethical Techniques for Successful Mediation

Successful mediation requires building trust and establishing clear communication between the parties and the mediator.  Specific tools and ethical considerations will be provided to obtain the information you need to obtain a resolution your client can accept and feel good about the settlement.  

Discussion of protection of attorney client and work product privileges during mediation. Overview of insurance coverage and contributions from third parties such as realtors. Techniques to streamline multiparty cases and construction defect mediation to ethically obtain an early settlement. Discussion of inexpensive mediation options for real estate purchase disputes, landlord-tenant and HOA matters.  

The panel will help you demonstrate to your clients that what Abraham Lincoln said in 1850 is true today, “Discourage litigation. Persuade your neighbors to compromise whenever you can. Point out to them how the nominal winner is often a real loser — in fees, expenses, and waste of time. As a peacemaker the lawyer has a superior opportunity of being a good man.”

Judge Bruguera served 27 years as a civil judge of the Los Angeles Courts.  She handled cases from controversial high publicity jury trials to partition actions and unlawful detainer actions.  Judge Bruguera understands what it takes to settle or try your case.  She began her career as a California State Assistant Deputy Attorney General handling complex business and tax matters and Medi-Cal fraud for nearly five years. Prior to that, she was a Deputy District Attorney for the County of Los Angeles and spent a year in private practice.

Barry Ross was nominated as a 2013 California State Bar Real Property Person of the Year Award.  Mr. Ross’s 40-plus years experience in business, real estate, banking and finance, estate planning and probate litigation and legal practice, including state and federal trial advocacy and administrative proceedings, has made him a leader in the ADR field.

Michael Jay Simkin, Moderator

Michael Simkin is a litigator and managing partner of Simkin & Associates, Inc. Mr. Simkin is licensed to practice law in California, New York, and the District of Columbia. His practice focuses on real estate, business law and immigration law for Canadians who want to live or work in the U.S. 

Mr. Simkin has appeared on Fox TV in Los Angeles discussing legal issues, is a speaker for the Continuing Education of the State Bar of California annual Real Property Conference and the California Lawyers Association Annual Conference.  He has presented several webinars for the Real Property and Business Law Sections. Mr. Simkin is also an article editor for the California State Bar Real Property Journal and had his article published in the CLA Real Property Journal analyzing the new Tenant Protection Act of 2019, as well as being an author of several eNews articles for the Real Property Section.  Mr. Simkin is also a member of the Real Property Executive Committee for the California Lawyer’s Association for the State Bar of California.
