California Attorney General Offers Second 2019 Presentation before the Nonprofit Organizations Committee

On March 21, the Nonprofit Organizations Committee welcomed Tania Ibanez, the Senior Assistant Attorney General in charge of the Charitable Trust Section of the California Attorney General’s Office, to discuss matters of interest to charities and other nonprofits in California for the second time in 2019. 

Ms. Ibanez offered a detailed presentation on the registration and reporting requirements for charities in California, including how staff at the Attorney General’s office review submissions and examples of what they specifically look for, and she discussed Attorney General enforcement activities involving charities.   After her presentation, Ms. Ibanez took questions from attendees and addressed, among other things, whether charities that failed to meet a statutory notice requirement to the Attorney General for a transaction should still provide the notice after the fact (they should), the circumstances under which nonprofit mutual benefit corporations need to register with the Charitable Trust Section, and what to do if a charity has missed several annual reports.  A copy of the PowerPoint presentation is at the following link.

As mentioned, the Nonprofit Organizations Committee has now welcomed Ms. Ibanez twice in 2019.  During her earlier visit, in January, she presented a comprehensive overview of the Attorney General’s proposed rulemaking from the end of 2018, which addressed updates to the registration and reporting obligations surrounding charities and charitable fundraising.

At its meeting in April, the Committee will host a program on the topic of “The Changing Environment of Sexual Abuse and Liability Insurance,” presented by Rand Chritton and Brian E. Johnson from the Nonprofits Insurance Alliance.  The Committee’s May meeting will feature a discussion with Audrey Rowe from the California Franchise Tax Board on matters of interest to nonprofits in California.
