Arbitration has grown in leaps and bounds over the last few decades. Court crowding, the difficulty of even getting before a judge on minor motions, judges’ predilection to toss cases via summary disposition as a way of pruning dockets, partisan judges – all these factors have pushed many run-of-the-mill commercial cases into arbitration.
