This month, Neil Kalin and Michael Simkin will discuss:
- Whether an easement can be acquired by both implication and prescription;
- Whether smoke damage triggers insurance coverage;
- Whether the Fair Housing Act, which permits use by a protected class with restrictions, is discriminatory; and
- Whether an easement holder’s duty to maintain includes the duty to construct improvements to protect the easement.
