Webinar: Supportive Decision Making

The purpose of the webinar will be to discuss Assembly Bill No. 1663, (A.B. 1663),”Protective Proceedings,” new legislation that became effective January 1, 2023. The stated intent of AB 1663 is to make all conservatorships harder to get and available as a mechanism of last resort. This intent is effectuated by requiring the petition to detail what least restrictive alternatives were considered, why they were not viable, and why conservatorship is necessary. The application of a less restrictive analysis, including a supported decision-making analysis, to all conservatorship petition is demonstrated by the Judicial Council’s revision of the mandatory Conservatorship Form GC-312. As modified From GC-312 makes the entry of information addressing supported decision-making necessary. The learning objectives will be to understand the additional requirements arising from these changes as well as to appreciate the existing unfunded mandates.
