Without federal legalization, cannabis operators are faced with challenges in protecting their trademark rights. State trademarks are one way for owners to protect their brands in states with legal cannabis markets. But, not all state applications or examination procedures are the same. Hear from experienced practitioners as they share tips and strategies for navigating the state trademark landscape for cannabis and hemp operators, as well as a discussion about the potential value of state trademarks if (and hopefully when) legalization occurs.

Nicole A. Katsin is a Senior Associate at Evoke Law, PC who focuses her practice on intellectual property, technology, and cannabis matters, including U.S. and international trademark and copyright prosecution and enforcement, Trademark Trial and Appeal Board proceedings, licensing agreements, and Internet policies. She also advises on consumer protection issues such as cannabis packaging and labeling compliance and product recall plans. Nicole specializes in assisting clients develop a comprehensive and defensible trademark strategy leveraging common law, state, federal, and international rights.
Chelsie Spencer is a founding member of Ritter Spencer PLLC. Chelsie represents all facets of the cannabis and hemp industries, including dispensaries, growers, processors, manufacturers, retailers, and more. Forbes Magazine dubbed her the “rare friendly face in the midst of a cutthroat CBD hurricane, the person you want on speed dial when things turn sour” for her work in the cannabidiol (CBD) industry. In addition to navigating complex issues and transactions in these highly regulated industries, she frequently writes, speaks, and presents on issues affecting these industries across the United States.
She is licensed in both Texas and Florida and has represented clients in federal and state litigation throughout the nation, at both the trial and appellate level.
Amanda R. Conley is the founder of Conley Law, a boutique intellectual property and advertising law firm. Prior to founding Conley Law, Amanda was a founding partner at Brand & Branch LLP and co-founder of the International Cannabis Bar Association. She helps creative entrepreneurs across a variety of industries protect, leverage, and enforce their intellectual property.
