Webinar: Proving Likelihood of Confusion in Court and at the TTAB: Differences, Tricks and Tips

Section 2 (a) of the Lanham Act addresses likelihood of confusion. Although the standards for determining that are largely the same in Federal Court and at the TTAB, they take different approaches to the question. The program explores these differences and offers tips on how to address them. It is designed for practitioners who do not have a lot of experience in either forum but who should know the differences between them.

Allison Berk is an attorney in Dickenson, Peatman & Fogarty’s Intellectual Property group. Her practice focuses on the prosecution and enforcement of client trademark rights, including trademark clearance, prosecution of applications for registration before the United States Patent and Trademark Office, and enforcement. Allison has litigation experience representing clients in federal court and before the Trademark Trial and Appeals Board.  
Allison earned her J.D. from the University of California, Berkeley, School of Law. She earned her B.A. in International Relations and African/African American Studies from the University of California, Davis. 
 
Prior to joining DP&F, Allison litigated antitrust and consumer cases. She also counseled business owners in transactional matters including commercial leases, contracts, business formation, and employment law. 
 
Allison is Chair of the Sonoma County Bar Association’s Intellectual Property and Business Law Section.

Allison Berk

Joy Durand is an attorney in Dickenson, Peatman & Fogarty’s Intellectual Property Group. Her practice focuses on developing and managing U.S. and international trademark portfolios including trademark clearance, prosecution of applications for registration before the United States Patent and Trademark Office, and enforcement. Joy also has extensive litigation experience representing clients in federal court and before the Trademark Trial and Appeals Board.  Joy earned her Bachelor of Science degree at Saint Mary’s College of California, her Master’s degree in Business Administration from Sonoma State University and her Juris Doctor degree from the University of San Francisco School of Law.

Joy Durand

Paul Reidl has been practicing law for over 40 years and is Of Counsel to Dickenson, Peatman & Fogarty (DPF) in Napa. He is a frequent litigator before Federal courts and the TTAB. He has also testified as an expert witness on numerous occasions. 

Paul had a very diverse career prior to joining DPF. He spent 10 years as a litigator with Crowell & Moring in Washington DC, then became Associate General Counsel of E. & J. Gallo Winery for 18 years, and then formed his own boutique law firm. In 2006, he was President of the International Trademark Association. He is a frequent speaker and writer on trademark issues, was a faculty member of the Practicing Law Institute for 10 years, has been a guest lecturer at George Washington University (GWU), and has conducted several training sessions on wine trademarks for the USPTO.  He also taught Speech Communication at GWU for 3 years. His most recent CLA presentation was for the “The PTO Comes to California” program in 2023 where he spoke on trademark use.

Paul received his B.A. (in political science and speech communication, with a minor in theology) in 1977 and a J.D. in 1980 from GWU, where he was a member of Phi Beta Kappa and the Law Review.
