This course will address new case law and recent statutory revisions which promise to affect the practice of construction law in California in the years to come. Join noted construction law practitioners Jessica Bogo, Esq. of Pillsbury Winthrop Shaw Pittman LLP and John Carpenter, Executive Vice President and General Counsel, Shimmick Construction, as they review notable substantive and procedural changes in California construction law and provide pointers and “best practices” in light of such changes.
Jessica Bogo is a construction lawyer with Pillsbury Winthrop Shaw Pittman, LLP, representing developers, owners, and builders throughout the construction process and dispute resolution, with an emphasis on complex projects, contract issues (including delay, change orders, and payment issues), and contractor licensing. She is co-editor and a contributing author of the upcoming third edition of Fundamentals of Construction Law published by the American Bar Association and is a frequent speaker around the country on construction law and attorney ethics. She received her B.A. from Davidson College and her law degree from the Georgetown University Law Center. Prior to moving to San Francisco in 2010, Jessica had lived in Ohio, Georgia, North Carolina, Rome (Italy), Cambridge (UK),Virginia, and DC. In 2016, she was named a “Best LGBT Lawyer Under 40” by the National LGBT Bar Association and is an avid supporter of the hiring and retention of diverse talent in the legal profession and in the construction industry.
Aaron Silberman is a managing shareholder at Rogers Joseph O’Donnell, PC, and co-chairs its Construction Practice Group. He has practiced construction law since 1992, representing general and specialty contractors, suppliers, design firms and construction managers on large public and commercial projects. He is an experienced litigator, representing clients in state and federal court proceedings, through trial and appeal; administrative law proceedings, including federal, state and local bid protests and claims; and ADR in disputes over contract terms and compliance, fraud and false claims, terminations, responsibility conflicts of interest and performance evaluations. He has also advised and assisted clients in drafting and negotiating contracts, conducting internal investigations, debarments, and licensing proceedings. Mr. Silberman is a former chair of the ABA Public Contract Law Section; served on the ABA Forum on Construction Law’s Governing Committee and chaired its Publications Committee and Specialty Contractors Division; and chaired the AGC of California’s Legal Advisory Committee and SF Bay Bridges District Board of Directors.
