Coming Next in the California Labor and Employment Law Review

In the May issue’s main feature, Noah D. Lebowitz offers some hope to labor and employment aficionados grappling with a long-unsettled issue: whether the Fair Employment and Housing Act (FEHA) imposes a duty on employers to provide accommodations to employees based on their associations with people who have a disability. Lebowitz points to a trio of recent federal court cases that hold promise for putting that question to rest. (Spoiler alert: Accommodations likely required.) The article delves into the issue, the tangled history of the FEHA, posits what might come next for courtwatchers and practitioners—and telegraphs the hopeful result of “less adversarial positioning, less litigation, and more satisfactory outcomes for all stakeholders.”
