Evans on his recent appointment to the Executive Council of the National Conference of Bar Presidents (NCBP). Evans was elected this month to a three-year term on the council, which serves as the governing body for the organization. The California Lawyers Association (CLA) commends the American Bar Association’s (ABA) passing of a resolution opposing revision to the law prohibiting lawyers from sharing legal fees with non-lawyers and from transferring to non-lawyers ownership or control over entities practicing law. Resolution 402, passed during the ABA’s annual conference in Chicago, upholds the notion that “sharing of legal fees with non-lawyers and the ownership or control of the practice of law by non-lawyers are inconsistent with the core values of the legal profession.” Read more

A well-worn adage, variously attributed to Abraham Lincoln or Benjamin Franklin, holds that any person – including a lawyer – who represents himself has a fool for a client. And if those two luminaries were alive today in an age where many legislative frameworks as well as contract clauses provide for attorney fee awards to a prevailing party, they might have further observed that this same fool attorney would not get paid.
