HEALTH LAW STANDING COMMITTEE 2024 APPELLATE LITIGATION UPDATE

There were numerous important appellate decisions dealing with health law issues in 2024, including decisions by the California Supreme Court, the California Court of Appeal, and the Ninth Circuit Court of Appeals. Following are summaries of the supreme court decisions and pending health law matters, as well the holdings of intermediate appellate health law decisions by the Ninth Circuit and California courts of appeal.

The appellate decisions are organized into the following six categories: (1) Peer Review and Discipline; (2) Regulation of Healthcare; (3) Medi-Cal, Medicare, and Medicaid; (4) Professional Liability, Elder Abuse, FEHA, and MICRA; (5) Arbitration; and (6) Fees, Costs, and Insurance.
