What are the damages?” This is, perhaps, the most fundamental question in any case of IP infringement. Without a proper understanding of what your client’s damages may be, it is nearly impossible to appropriately assess a best course of action. A well-reasoned and convincing summary of how those damage numbers are reached is also critical at the trial level.
