What’s Up With Us! is the Real Property Law Section’s monthly case and section update. This month co-host Neil Kalin will do his best to reign in co-host Michael Simkin as he speculates and discusses the month’s cases so that we can make it through all of our advertised cases. But, let’s face it, you attend to hear Michael express his litigator point of view, so maybe I’ll just keep quiet. As usual, attendees will earn one hour of self-study MCLE for free. Plus, every attendee has a chance to win a gift card for one hour of MCLE credit from the pre-recorded RPLS library. You will be provided with a copy of the presentation material and your self-study certificate after the meeting. This month’s cases cover the following:
- Does using a garage for storage, and parking in a shared driveway provide grounds to issue a notice to perform or quit to a tenant?
- Does a property manager have authority to initiate an unlawful detainer?
- What is the proper test to be applied to determine if a traffic mitigation fee imposed on new development by statute or ordinance, as opposed to a property specific regulatory fee, is an unlawful taking?
- Is a property tax based on value approved by voters in a citizen initiative a valid exercise of a city’s authority?
