What’s Up With Us! is the Real Property Law Section’s monthly case and section update. This month co-hosts Neil Kalin and Michael Simkin will interview a Deputy City Attorney for the city of Santa Monica and also engage in our regular pontification about cases addressing the following issues:
- Whether governmental immunity applies to a slip and fall in a government owned parking lot;
- Whether a mobile home rent ordinance is invalid if it fails to provide a process to determine if the owner is getting a fair rate of return.
- Whether police action causing damage to real property is considered an unlawful taking without compensation; and
- What is the proper test to be applied to determine if a traffic mitigation fee imposed on real property development by statute or ordinance, as opposed to a property specific regulatory fee, is an unlawful taking.
The weather outside’s delightful (at least in California). The cases, though, are so frightful. If you’ve got nowhere else to go.
