This presentation by Elijah Keyes explores how to identify capacity levels, manage undue influence risks, and meet ethical duties while preserving client autonomy. Attendees will gain practical strategies for assessing capacity under California law, communicating effectively with impaired clients, and documenting decisions to protect both client and attorney.

Elijah Keyes, J.D., LL.M. is a Certified Legal Specialist in Estate Planning, Trust, and Probate Law with more than 16 years of experience in estate planning, elder law, and tax. He earned both his JD and his LL.M. in Estate Planning and Business Tax from Golden Gate University School of Law.
Elijah is a former adjunct professor at Golden Gate University School of Law and previously served as Vice President and Trustee of the Silicon Valley Bar Association. He is a frequent speaker and published author on topics including trusts, estate planning, elder law, and tax, with a particular focus on the real-world human and psychological impacts of estate planning. In his presentation, Where Estate Planning and Mental Health Collide, Elijah draws on his professional experience to explore how cognitive decline, family dynamics, stress, and mental health issues intersect with legal decision-making and long-term planning.
Elijah is married, has two children, and a dog named Leia. Outside of his legal practice, he enjoys obstacle course racing and tackling hands-on DIY projects.
