This presentation will provide an overview of the attorney-client privilege, particularly as it relates to the role of in-house counsel.  The panel will discuss situations often faced by in-house counsel and the best practices for navigating these scenarios to avoid unintentional waiver. Among other topics, the panel will discuss:

  • The scope of the attorney-privilege and its application to in-house counsel
  • How the privilege applies in matters involving joint representation
  • When dual purpose communications are protected
  • The role of privilege in internal investigations
  • How to avoid waiver in cross-border communications

Michael Boardman is an Associate in Baker & McKenzie’s North America Litigation and Government Enforcement Group and is based in their Los Angeles Office. Michael is a commercial litigator and focuses on commercial and consumer litigation at the trial and appellate levels across an array of issues ranging from general commercial disputes over contracts, business torts, franchise law, intellectual property, antitrust, RICO, insurance coverage and unfair competition.  Michael also has substantial experience representing clients in investigations and claims brought by government entities, including the United States Department of Justice, California Attorney General, Securities and Exchange Commission, California Insurance Department and others.

Michelle Chung is an Associate in Baker & McKenzie’s North America Litigation and Government Enforcement Group and is based in their Los Angeles Office. Michelle is a commercial litigator and has developed a broad practice focusing on all areas of business and commercial litigation. Her previous experience includes representing clients in commercial matters based on contract claims, unfair competition, false advertising, fraud and related business torts.  In particular, Michelle’s litigation practice involves representing clients in the consumer protection actions, franchise, and labor and employment spaces in California.

Nancy Sims is a partner in Baker McKenzie’s North America Litigation and Government Enforcement Group and is based in the Los Angeles office. Nancy is a commercial litigator focusing on class actions and complex business disputes and investigations. Her previous experience includes representing clients in commercial matters based on contract claims, unfair competition, false advertising, fraud and related business torts. In particular, Nancy’s litigation practice involves defending class actions in the consumer, franchise, insurance, and labor and employment spaces. She has represented clients in putative class actions and other litigation with a combined exposure of over USD 1 billion. In addition, Nancy also has extensive experience conducting corporate internal investigations and government investigations, including those implicating the Foreign Corrupt Practices Act and UK Bribery Act.

Sanjesh Sharma is Senior Intellectual Property Counsel at Johnson & Johnson Surgical Vision, where she supports all aspects of intellectual property matters for the business’s laser refractive and cataract surgery product lines. She manages global patent portfolios, due diligence for acquisitions and transactions, freedom to operate clearances for product development, as well as any litigation and related inter partes proceedings in the U.S. and opposition/nullity actions in Europe.  Sanjesh is the current Chair of the IP Law Section and the Patent Interest Group.
