Bias can affect every stage of an employment case—and every player involved. Two seasoned employment litigators offer practical tools to avoid and confront bias in case selection, discovery, advocacy, settlement valuation, jury selection and more. You’ll come away with strategies to deal with bias because of protected characteristics, whether it comes from attorneys, clients, experts, mediators, arbitrators, judges or juries.

For over 30 years, Mr. McInerney, a co-founder of Ogletree’s San Francisco office, has been a labor and employment advisor and litigator for many of the Bay Area’s most prominent companies. Mr. McInerney has a broad L&E practice, and defends employers in complex litigation matters. He has tried to verdict many cases in both state and federal court in several states, and he represents clients in a wide range of fields. Mr. McInerney served as Co-Chair of the Lawyers Committee for Civil Rights of the San Francisco Bay Area.

For over two decades, Supreeta Sampath legal career has focused exclusively on employee-side employment law. From 2011 to 2013, Ms. Sampath was selected by Los Angeles Lawyers Magazine as a Rising Star in the field of Labor and Employment. Since 2014, she has been selected as a Super Lawyer, a distinction given to no more than 5% of attorneys. In 2024, Ms. Sampath was the recipient of the Joe Posner award, the highest distinction awarded by the California Employment Lawyers Association.

Phil Horowitz has represented employees for over 40 years. He litigates cases for wrongful termination, sexual harassment, disability discrimination and unpaid equity. Mr. Horowitz won the leading California Court of Appeal summary judgment case Nazir v. United Airlines. He’s served in the leadership of the Labor and Employment Law Section of the State Bar (now part of CLA) since 2002, including as Chair. Mr. Horowitz was Chair of the California Employment Lawyers Association, and on its Board for 17 years. Mr. Horowitz volunteer teaches trial advocacy at Stanford University.
