Webinar: An Overview of Discovery Practice in Trust and Estate Litigation

There has been a steady increase in trust and estate litigation of civil procedural practices, including all forms of discovery. The mere mention of discovery can evoke fear and trembling in the most seasoned counsel. Nevertheless, effective discovery practice can hasten dispute resolution, increasing the likelihood of good (and sometimes even fair!) results. Â

The presenters will provide an overview of the various forms of discovery, their respective procedural frameworks, how they may come into play at different stages of litigation, and party obligations on both sides. The presenters will review recent trends in interpretation and enforcement of the Discovery Act with attention to their application and considerations specific to trust and estate litigation. Â

Lily Moallem Harris, Esq. is a shareholder in Weintraub Tobin’s Trusts and Estates Litigation practice group. She is an experienced litigator who represents clients in a broad range of matters, with a primary focus on trust and estate litigation. A California State Bar Certified Legal Specialist in Estate Planning, Trust and Probate Law, she provides comprehensive representation in contested estate, trust, guardianship and conservatorship cases. Lily also oversees the administration of complex trusts and estates and provides wealth planning services. Lily is a contributor for the CEB Treatise on Crossover Issues in Estate Planning and Family Law. She regularly speaks on trusts and estates issues, including for the National Business Institute and at the annual Fiduciary Attorney Summit.

Evan Darwin Winet, Esq. is of counsel in Weintraub Tobin’s Trusts and Estates Litigation practice group. He has over a decade of experience representing beneficiaries, fiduciaries and charities in disputes and litigation involving trusts, estates, and conservatorships as well as parties in actions for financial elder abuse. Evan speaks frequently on issues relating to trust and estate litigation, has contributed articles on trust and estate litigation to the ACTEC Journal and the California Trusts & Estates Quarterly, is annual editor of the CEB Practice Guide for Probate & Trust Litigation and volunteers with the Litigation Sub-Committee of TEXCOM.Â

Madeline (Maddie) Giles, Esq. is an associate in Weintraub Tobin’s Trusts and Estates Litigation practice group. She specializes in trust litigation, and practices broadly within probate, including conservatorships and estate administration. Maddie has represented conservators, beneficiaries, trustees (including fiduciaries), among other interested parties, from both plaintiff and defense sides. Maddie is a member of Sacramento Estate Planning Council, the Sacramento County Bar Association, and a liaison with the New Lawyers Executive Committee of the California Lawyers Association.
