This webinar addresses one of many challenging aspects of employment law: balancing employer interests in protecting their business while respecting employees’ Section 7 rights under the National Labor Relations Act. Panelists will discuss the intersection of social media, off-duty conduct, and protected concerted activity and provide guidance on navigating the complex boundaries between legitimate workplace rules and unlawful restrictions on employee communications.

Christy J. Kwon is Regional Attorney of the National Labor Relations Board (NLRB) at its Oakland regional office (Region 32), which has jurisdiction over portions of northern California and the northern half of Nevada. She is an Advisor to the Executive Committee of the California Lawyers Association’s Labor and Employment Section. She is a founding member of the Bay Area Federal Employee Pro Bono Program and the former Co-chair of the Public Law Committee and the Civil Rights Committee of the Asian American Bar Association of the Greater Bay Area. Ms. Kwon earned her J.D. from UCLA School of Law, and her B.A. from U.C. Berkeley in Ethnics Studies and Sociology.

Thomas Lenz is a partner in the Atkinson, Andelson, Loya, Ruud & Romo law firm with an office in Pasadena, California. He leads the firm’s labor relations team and handles matters for clients across California and the west. He began his career as a field attorney with NLRB Region 21 in Los Angeles where his caseload regularly made use of his fluency in Spanish. He served the Executive Committee of the Labor and Employment Law Section when it was a part of the State Bar of California. He Chaired the Section during the year the Section transitioned from the State Bar to the California Lawyers Association. He continues to serve as an Advisor to the Section. He is frequently consulted by the media on workplace issues. He teaches at USC Gould School of Law. His victories at the District of Columbia Circuit in Nova Plumbing and Colorado Fire Sprinkler cases were recently cited by the NLRB in the effort to enact a new rule on voluntary recognition of labor unions in the construction industry.

Passionate about Helping Businesses Mitigate Legal Risks and Achieve Organizational Success Drawing on 16+ years of corporate legal experience, I provide strategic legal guidance and partner with leadership to navigate complex regulatory frameworks. Working closely with teams across departments, I focus on developing practical solutions in corporate governance, regulatory compliance, HR strategy, and contract and litigation management.
My industry experience spans technology, supply chain, retail, manufacturing, transportation and food & beverage sectors.As a volunteer Advisor to the California Lawyers Association’s Labor & Employment Section, I have the privilege of contributing to the Inhouse Practitioner’s Program. Working alongside talented HR professionals and In-House counsel, we focus on building capabilities that help create more inclusive and legally sound workplaces. Outside of my professional role, I find joy in spending time with family and friends, building and designing living spaces, and spending time with my toy poodle – experiences that help maintain perspective and balance.
