What’s Up With Us! is the Real Property Law Section’s monthly case and section update. This month co-hosts Neil Kalin and Michael Simkin will talk about cases addressing the following issues: 

  1. What proof and pleadings are required to justify tenant withholding of rent for alleged illegal unit?
  2. What is the practical impact of Eshagian v. Cepeda now that the Supreme Court has declined the depublication requests?
  3. Is continued agricultural use a valid condition for constructing residential units on ag-zoned land? 
  4. Are floodwaters in an aquifer personal or real property? and 
  5. Does a County Board of Supervisors have authority to determine base-year value of property for property tax purposes?
