What’s Up With Us! is the Real Property Law Section’s monthly case and section update. This month co-hosts Neil Kalin and Michael Simkin will talk about cases addressing the following issues:
- What proof and pleadings are required to justify tenant withholding of rent for alleged illegal unit?
- What is the practical impact of Eshagian v. Cepeda now that the Supreme Court has declined the depublication requests?
- Is continued agricultural use a valid condition for constructing residential units on ag-zoned land?
- Are floodwaters in an aquifer personal or real property? and
- Does a County Board of Supervisors have authority to determine base-year value of property for property tax purposes?
