THE EVOLVING LAW ON TRADE SECRET IDENTIFICATION
THE NINTH CIRCUIT COURT OF APPEALS RECENTLY DECIDED a case of importance regarding a plaintiff’s disclosure of its asserted trade secrets for a Defend Trade Secrets Act ("DTSA") claim. In Quintara Biosciences, Inc. v. Ruifeng Biztech, Inc., 149 F.4th 1081, 1085 (9th Cir. 2025), the Ninth Circuit clarified some principles of trade secret identification in a case with relatively unique procedural history. While the appellate decision answered some questions about trade secret identification, it left many other issues unresolved.
