Updates by the California Attorney General’s Office

Please join the Nonprofit Organizations Committee for a program on the topic: Updates by the California Attorney General’s Office. Topics that will be covered include: Assembly Bill 488, a new law governing charitable fundraising on internet platforms, regulations that will be proposed soon relating to AB 488, implementation of a registration fee increase and, time permitting, an overview of the Attorney General’s oversight, registration and reporting by charities and fundraisers, and enforcement actions (Civil and Administrative Actions). 

The program will be presented by Tania M. Ibanez, Senior Assistant Attorney General, California Attorney General who is in charge of the Charitable Trust Section of the California Attorney General’s Office. Ms. Ibanez supervises the work of the Registry of Charitable Trusts located in Sacramento where charities and fundraisers are required to register and file annual reports. Ms. Ibanez also directs the work of the auditors and attorneys and approves all litigation initiated by the Charitable Trust Section. The Charitable Trust Section investigates and litigates legal and administrative actions for registration and reporting violations, deceptive solicitation and misrepresentation in public filings, and seeks penalties and damages for loss of charitable assets through fraud, diversion, self-dealing transactions, excessive compensation, waste and mismanagement. With over 30 years of litigation experience, Ms. Ibanez is the Attorney General’s technical expert on charitable trust enforcement actions and probate litigation. Ms. Ibanez also approves and evaluates all proposed statutes and regulations pertaining to charities and fundraisers and provides advice and technical assistance to the Attorney General on policy topics involving charities, charitable trustees and nonprofit hospitals. As Senior Assistant, Ms. Ibanez also oversees the publication of training and educational guides to advise and educate the public about the Attorney General’s regulatory role and the issues affecting charities and fundraisers. She is a frequent guest speaker at conferences addressing charity issues.
