General Statement of Policy.  Any person seeking Amicus Curiae support from TEXCOM must fill out the Request for Consideration of Amicus Curiae Support Form located here, and submit the forms and send attachments to:  trustsandestates@calawyers.org. with a subject line of “Amicus Curiae Request”. The following additional criteria must be met:

TEXCOM recognizes that litigation between third parties primarily involves adjudication of claims between those parties, who frequently have important, but private, interests at stake.  Thus, TEXCOM’s general policy with respect to participation in litigation between third parties is one of nonintervention.  Requests for amicus curiae letters regarding a pending or proposed petition for review (as opposed to requests for amicus curiae briefs in matters in which review has already been granted) are disfavored.. TEXCOM will only participate in litigation between third parties as amicus curiae where one or more of the following criteria are satisfied: (i) the court has specifically requested the views of the CLA or the Section, (ii) the issues directly affect the Section’s activities, or (iii) the views of the Section appear likely to make a material contribution to the court’s understanding of the issues, and one of the following conditions is present: (a) the issues are of substantial importance to the legal profession, the practice of law, or the administration of justice in the trusts and estates field, or (b) the issues are within the expertise or specialized knowledge of the Section.  Absent extraordinary circumstances, TEXCOM will not participate as amicus curiae in any litigation in which a person who is a member of TEXCOM is a part or counsel of record, or has another material interest known to TEXCOM in the outcome of the subject litigation.
