Intellectual Property Law

New Matter SUMMER 2016, Volume 41, Number 2

Letter from the Editor-in-Chief

THOMAS A. WARD ARRIS

Welcome to the summer edition of New Matter for 2016. The cover emphasizes marijuana and its effect on Intellectual Property. Details of trademarking marijuana and other IP issues are covered in the article "Growing like a Weed," in this edition. We thank the author of "Growing like a Weed" for his contribution to New Matter.

Issues of trademarking marijuana already are a major consideration for IP attorneys in California, and that will likely increase in the near future. Marijuana legalization is on the November ballot in California in 2016. Of course medical marijuana is already legalized in California, and that fact has led to trademarking issues that have been surfacing for a number of years. We are glad to have the opportunity to address some of those issues in this addition.

We would also like to thank the two authors who wrote on the recent Google Books decision. The fact that we have two articles and they have interesting opinions about the effect of the Google Books case on the fair use doctrine shows copyright attorneys practicing in California have concerns about the court decision.
