TIPS OF THE TRADE: THE PROFESSIONAL FIDUCIARY PRACTICE ADMINISTRATOR – A NEW KID IN TOWN

I. SYNOPSIS
There are currently over 800 active licensed professional fiduciaries in California.01 Because only individuals can hold themselves out as professional fiduciaries,02 and many professional fiduciaries handle large numbers of cases, the legislature has adopted new Probate Code sections 2469 and 9765 to assist the courts in providing smooth transitions when a professional fiduciary with a large number of cases dies or becomes disabled and there is no existing non-court supervised method for replacing the fiduciary.
Both new sections went into effect on January 1, 2024.03
