It is a time when those on both the left and the right are unsure whether American democracy will survive. Dean Chemerinsky will explain why the Constitution was deeply flawed from the outset and why the choices made in drafting it are responsible for our current political crisis. Ultimately, only repairing or replacing the Constitution can save American democracy.

In 2020, the Supreme Court resolved a longstanding circuit split with its decision in Romag Fasteners v. Fossil Group. As a result, proof of willful infringement is no longer required for trademark owners to recover infringers' profits. The decision makes it easier for trademark owners to recover infringers' profits and increase the damages awards.
