The EU Digital Services Act is the EU’s most ambitious reform package for intermediary liability and obligations to date. The European Union has adopted a modern legal framework whose scope includes the safety of users online, the establishment of governance with the protection of fundamental rights, and the maintenance of a fair and open online platform environment. We will discuss its scope of application, the numerous new obligations it sets out, its liability threshold, and the new regime of oversight and enforcement it establishes.

Anthonia Ghalamkarizadeh, a partner in the Hamburg office of Hogan Lovells, works with leading global online service providers – marketplaces and social media, gaming companies, video sharing sites, booking portals and app stores – as well as with many famous brands, on all aspects of intermediary regulation and liability, trademark law and unfair competition. Anthonia’s client base is strongly centered on internet services and software, consumer electronics and entertainment. She advises leading online service providers on EU provider liability regimes, with a focus on Digital Services Act implementation and compliance. Anthonia also has extensive experience in global brand enforcement strategy and litigation, and she develops and coordinates several cross-border enforcement programs for well-known brands.
