This panel will provide an overview of the estate planning and administration processes as they relate to intellectual property assets. Areas to be covered include the selection of the proper vehicle for transfer of patents, copyrights, and trademarks; income and estate tax considerations; use of a literary executor; methods for clearing a chain of title post-death; preservation of copyright termination rights; right of publicity issues; and what happens when there is no estate plan in place. Relevant case law illustrating how these issues play out in court will also be discussed.
