Webinar: Probate Guardianship Minor’s Counsel – How to Communicate with a Child Client

Attorney Stefanie M. Bennett has devoted her practice to representation of minors in judicial proceedings. In this program she will discuss the duty to communicate with the client, the communication styles for working with the child client. She will also discuss the application of several applicable rules and statutes. California Rules of Court Rule 7.1016 governs the participation and testimony of wards in guardianship proceedings. Family Code section 3042 addresses the role of a child witness in family law proceedings. The criteria applicable to a child for the purpose of informing the court directly of their preference as to custody or visitation, or orders granting or modifying custody or visitation. Similarly Evidence Code section 765, subsection (b) focuses the trial court’s attention on the examination of a witness under the age of 14 while Evidence Code section 767, subsection (b) authorizes the court to permit a child witness to be examined through the use of leading questions. She will conclude with a discussion of handling information provided by the child witness as well as the child witness providing testimony.

After graduating from Southwestern Law School in Los Angeles, Stefanie moved to Vienna, Austria where she divided her time between the United Nations – International Trade Law Commission and the offices of an international law firm. In 2000, she returned to California and represented foster children for six years as a staff attorney for the Children’s Law Center Los Angeles. In 2006 she opened her own practice focusing on court appointments as minor’s counsel in Family Law proceedings and guardianships in Probate Code. Since 2010, Stefanie has been appointed as Court Appointed Counsel (“CAC”) in limited and general conservatorship csae as well as Guardian ad Litem in select cases.
