Webinar: Hot Topics For Lenders And Secured Creditors, Part 2

Recent case law developments important to lenders and secured creditors including: 

  • Required interest payments to creditors of a solvent debtor in a Chapter 11 plan;
  • Potential enforcement of a guarantor’s obligations for defaulted debts after the guarantor’s bankruptcy discharge;
  • Traps for the unwary in enforcing security interests in a debtor’s litigation claims, including those against company directors and officers; and
  • Issues in recovering attorneys’ fees on tort claims against a contract counterparty.
  • This panel, comprised of four bankruptcy attorneys with decades of extensive experience in such matters, will discuss developments in the case law of particular interest to California practitioners, as well as some “best practices.”

Jessica L. Bagdanov

Jessica Bagdanov is a partner at BG Law, LLP, a boutique bankruptcy firm in Woodland Hills, CA. Jessica has significant and comprehensive insolvency and restructuring experience, consistently representing chapter 7 trustees and receivers, as well as both debtors and creditors in chapter 11 matters. Jessica also has significant business litigation experience and is routinely responsible for a wide range of motion practice in contested matters, adversary proceedings, and related appeals. Jessica presently serves as the Education Co-Chair for the Insolvency Law Committee, as a Board Member for the Los Angeles Bankruptcy Forum, an Associate Editor of the Business Law News section of the California Lawyers Association, and co-author of the Commercial Finance Newsletter. She has been recognized as a Southern California Rising Star by Super Lawyers from 2015-2022, and has been named among the “Best Lawyers in America” since 2018.

Dennis David Miller

Dennis D. Miller is an experienced bankruptcy attorney specializing in representing lenders and commercial landlords in large complex Chapter 11s.  He has represented clients in bankruptcy cases across the United States and also in district court and state court cases.  His case representation also includes workouts, loan restructuring and commercial litigation. He also has represented his clients in numerous avoidance actions, including preference and fraudulent transfer defense cases.  Dennis is AV Preeminent rated by Martindale-Hubbell, and in 2022 was selected to Martindale-Hubbell Preeminent Attorney-Judicial Edition. He has been chosen as a Northern California Super Lawyer in bankruptcy and creditor rights from 2010 to 2022. He has also been selected to Best Lawyers in America for 2020 to 2023 in bankruptcy and creditor rights. In 2014-2015 and 2018-2019, Dennis was Co-Chair for the California Bankruptcy Forum statewide conference.  He is a former President of the Bay Area Bankruptcy Forum and the California Receivers Forum-Bay Area Chapter.

Sharon Weiss is a seasoned insolvency partner in the Los Angeles office of Bryan Cave Leighton Paisner LLP.   She has extensive experience in a wide area of insolvency matters from various perspectives, including representation of debtors, secured lenders, asset purchasers and the interest of individual and corporate parties in insolvency matters. She has served as lead trial counsel in bankruptcy and commercial litigation, represented buyers of assets in high profile bankruptcy cases, DIP lenders, and is a sought after mediator.  Her clients include parties engaged in banking, real estate, consumer electronics, healthcare, restaurant, garment, entertainment, and retail sales industries. Gary Kaplan

Gary Kaplan

Gary M. Kaplan, is Chair of the Bankruptcy, Restructuring and Creditors’ Rights Group at the San Francisco firm of Farella Braun + Martel LLP.  He has over 30 years of experience representing debtors, creditors, creditors’ committees, trustees and receivers in a wide range of bankruptcy and nonbankruptcy matters. His practice includes both out of court and Chapter 11 restructurings, and advising clients regarding pre- and post-bankruptcy strategy, debt collection, judgment enforcement, and provisional remedies. He represents lenders and borrowers in a wide range of financing transactions, including debtor-in-possession financing, as well as lease and guaranty matters. He also has extensive litigation experience in bankruptcy and non-bankruptcy courts, at trial and appellate levels, including in the U.S. Supreme Court.  
 
Mr. Kaplan is Board Certified in Business Bankruptcy Law by the American Board of Certification and a Certified Legal Specialist in Bankruptcy Law by the State Bar of California.  He has been selected as a Northern California Super Lawyer for the years 2004-2006 and 2009-2020.  Mr. Kaplan is the former President of the Bay Area Bankruptcy Forum and former Chair of the Bankruptcy Law Advisory Commission, of the California State Bar.  He is also a frequent speaker on bankruptcy and insolvency law matters.
