Don’t forget about the $50,000 penalty! Wait what? That’s a thing? Yes! This penalty went into effect 1/1/2023, but is still poorly understood by most workers’ compensation professionals. Whether you are an applicant’s attorney, defense attorney, or Judge, this issue is lurking in all claims coming within Labor Code sections 3212 to 3213.2. (i.e., all of the public safety/fire presumption cases.) This penalty applies when a claim has been “unreasonably rejected.” What does that mean? Attend this 1-hour webinar to gain insights into what that may look like, when this new law is paired with the regulator requirement to conduct a good faith investigation. Presented by Randy Pollak.

Randy Pollak
Randy H. Pollak is the Director, California Attorney, for WCF Insurance Company, and is a Certified Specialist in Workers’ Compensation Law. Mr. Pollak is a widely known speaker and author, and was the former Managing Editor of the Workers’ Compensation Quarterly, the official legal publication of the California Lawyers’ Association.
Hon. Josephine Broussard
Judge Josephine K. Broussard is a Workers’ Compensation Judge at the Santa Ana Workers’ Compensation Appeals Board. Prior to becoming a judge, she worked as a Senior Associate Attorney for Pearlman, Brown & Wax where she focused in the defense of complex workers’ compensation claims including a focus in the area of sports litigation.
Prior to attending law school, she was a military spouse and worked in the area of financial services from 1998 to 2011 serving as Assistant Vice President for Wells Fargo Personal Lines and Loans Operation Center and Director of Compliance and Customer Contact Center for ING obtaining her securities license in Series 6, Series 26, and her Six Sigma Green Belt. She attended the University of Dayton School of Law graduating third in her class and received ten CALI Excellence for the Future Awards. While in law school, she was a member of Law Review and served as a Staff Writer and Business Manager for Law Review. She serves on the California Lawyers Association and is Chair of the Diversity subcommittee.
Most importantly, Josephine cherishes time spent with her husband and five children.
