Failure to function refusals are increasingly common in U.S. trademark applications and also more difficult to predict. This webinar will address the different types of “failure to function.” The primary focus will be on refusals based on a mark allegedly being too widely used to function as a trademark. Our speaker will discuss whether these refusals are legally valid and will suggest strategies for responding to them.

Mr. Sommer argued and won Iancu v. Brunetti in the U.S. Supreme Court. He is General Counsel for the street fashion brand Stussy, Inc., and he represents a limited number of other clients in trademark matters. Mr. Sommer attended UCLA School of Law.
