Webinar: Discovery in Commercial Arbitration: JAMS, AAA, FAA, and State Rules

This program will address the application of commercial arbitration discovery rules under JAMS, AAA, FAA, and State and Federal law from the standpoint of both the practitioner and arbitrator. The scope of permissible discovery under these rules will be addressed in the commercial context, including hearing and pre-hearing discovery; preparing in advance for discovery; proportionality and the limitation of discovery. 

The program will further address the scope of the arbitrator’s authority to determine disputes and discovery from third parties. Additionally, they will discuss the role of the arbitrator in seeking proportionality and cost-effectiveness in the discovery process.

Judge Louise LaMothe served for 10 years in Santa Barbara for the Central District of California, handling settlement conferences for the Court as well as a wide variety of criminal duties.  She practiced as an arbitrator and mediator for many years before her appointment and now continues her private ADR practice full time.  A Stanford Law School graduate and Martindale AV-rated litigator in Los Angeles for more than 20 years, she serves on several American Arbitration Association case panels.   She is a Fellow of the College of Commercial Arbitrators, the Chartered Institute of Arbitrators, and an International Mediation Institute-certified mediator.  She is a former Chair of the ABA Section of Litigation, and an ALI life member.  In 2020, California Women Lawyers named her its Distinguished Jurist of the Year. She has written and spoken throughout her career on gender equity and has been named one of California’s Top 50 Neutrals and a California Super Lawyer.   Her website is www.dispute-solutions.com.

Judge Gary Nadler has developed a reputation for settling challenging legal disputes throughout his career as both a judge and mediator. As a judge for 20 years on the Sonoma County Superior Court, Judge Nadler focused on resolving complex civil matters and case management prior to trial. As a neutral, he is known for his clear and focused understanding of the factual and legal issues and understanding the personal dynamics of the parties. 

While on the bench, Judge Nadler was elected presiding judge by his judicial colleagues for two terms. He was appointed to consecutive terms to the Judicial Council of California by the chief justice of the Supreme Court of California. He was appointed as a pro tem justice to the First District Court of Appeal in 2022. As a judge and neutral, he resolved highly emotional and complex cases, and was recognized by the Court of Appeals as a “most experienced” jurist in McClain v. Kissler 39 Cal.App.5th 399 (2021).
Prior to appointment to the bench, Judge Nadler was an AV-rated attorney. His law practice included antitrust, personal injury, complex business litigation, construction defect litigation and employment matters.

Widely recognized for her legal work in consumer protection cases, Doris Cheng has been ranked as one of the top 50 women lawyers and top 100 lawyers in Northern California. She is listed among the Best Lawyers of America®, LawDragon 500 Leading Lawyers, SuperLawyers® and San Francisco Best Lawyers. She was chosen as Lawyer of the Year by Best Lawyers of America for 2017. Ms. Cheng is a partner in the law firm of Walkup Melodia Kelly & Schoenberger in San Francisco. She has obtained eight and nine-figure results on behalf of catastrophically injured plaintiffs. She is a past President of the San Francisco Chapter of the American Board of Trial Advocates, the Bar Association of San Francisco, Justice & Diversity Center, and the San Francisco Trial Lawyer Association. She has been inducted into the International Academy of Trial Lawyers and the American College of Trial Lawyers. She serves as a member of the National Judicial College Board of Visitors and Kaiser Arbitration Oversight Board. As part of her commitment to the rule of law, Ms. Cheng has led training programs for trial lawyers and judges in Northern Ireland, Scotland, Italy, Singapore, Kosovo, Macedonia, and throughout the Caribbean Basin.
