Webinar: AI in Litigation: Opportunities and Threats On The Next Great Frontier

August 24, 2023 @ 12:00 pm 1:00 pm

1 Hour MCLE

As with many other industries, artificial intelligence is reshaping the world of litigation at an incredible speed.  It is impossible to maintain an active litigation practice today without touching upon some aspect of AI.

Firms, companies, and others are developing or have developed AI tools that touch every aspect of the life cycle of a lawsuit, including without limitation:

  • Analyzing a case file to advise as to whether an attorney should take on a case (and later analyzing the value of the case in connection with settlement discussions)
  • Generating pleadings, discovery requests, and deposition questions, and analyzing responses to the same
  • Performing legal research, document review, and contract analysis
  • Deciphering the facial expressions of jurors for jury selection and trial outcome prediction purposes

Each of these AI capabilities represents an opportunity and a threat.  These tools obviously offer vast potential for providing efficient results to clients and freeing up attorney time for higher-level strategy.   However, there are also immense risks, including unknowns regarding the inner workings of the technology and how it arrives at the output, biases of the creators of the products, and even the threat of self-fulfilling prophecies along the lines of the movie Minority Report. Given the limited time of one hour, this program will focus on three key aspects of a litigation life cycle, and analyze AI tools, the opportunities they present, and the threats that loom:

  • Discovery and Motion Practice
  • Evidence and Expert Testimony
  • Trial Preparation/Jury Selection

Arjun Sivakumar

Arjun Sivakumar is a partner in the Firm’s Litigation & Arbitration Practice Group and is co-chair of the Firm’s Diverse Attorneys Working Network.

Arjun focuses his practice on complex business litigation in state and federal courts and arbitration, and has appeared as first-chair litigation counsel in key trial court proceedings and before the Ninth Circuit Court of Appeals. He understands that strategy at the outset is crucial in approaching any dispute. In some cases, the right approach is to pursue early negotiations with opposing counsel, in an attempt to resolve the matter before going to court. In other cases, the correct approach is to be aggressive out of the gate to force the other side to the negotiating table. Arjun is adept at executing either strategy for his clients, who have ranged from victims of schoolyard bullying to billion-dollar companies, and has delivered excellent results in both scenarios.

In addition to his practice, Arjun is active in the community, serving as a member of the Education, Leadership Development, and Diversity, Equity & Inclusion Committees for the Orange County Bar Association and the House & Social Committee for the Pacific Club.  Arjun has also appeared as a contestant on Jeopardy!
